Terms of sale and privacy policy

The owner of the online shop Vitaplus.ee (hereinafter referred to as the Online Shop) is Vitaplus OÜ (registration code 16122633), located at Riia mnt 81A-28, Viljandi.

Validity of the sales contract, commercial and price information

The terms and conditions of sale apply to the purchase of goods from the Online Shop.

The prices of the products sold in the online shop are indicated with the products. The price is subject to a delivery charge. All prices of goods sold in the online shop are in euro.

The delivery fee depends on the location of the buyer and the delivery method. The delivery charge is displayed to the buyer when placing the order.

Information about the goods is provided on the Online Shop directly next to the goods.

Placing an order

To order, you must add the products you want to your shopping cart. In order to place an order, you must fill in the required fields and select the appropriate delivery method. The amount of the fee is then displayed on the screen, which can be paid by bank transfer or other payment method.

Payments are intermediated by Montonio Finance OÜ. Payment is made outside the Online Shop in a secure environment – in the case of payment by bank transfer in the secure environment of the respective bank. The seller does not have access to the customer’s bank and credit card details. The contract enters into force from the moment the amount due is credited to the account of the Webshop.

The owner of the online shop is the controller of personal data and forwards the personal data necessary for the execution of payments to the processor Montonio Finance OÜ.

If the ordered goods cannot be delivered due to expiry of the goods or for any other reason, the buyer will be informed as soon as possible and the money paid (including delivery costs) will be refunded, usually within 1-2 working days. Depending on the method of payment, it may take up to 7 working days to receive the payment.

Delivery to

Goods are sent to Estonia, Finland, Latvia, Lithuania.

The buyer has the following options for picking up the goods: Smartposti and Omniva.

The shipping costs are borne by the buyer, and the corresponding price information is displayed with the shipping method.

Shipments within Estonia usually arrive at the destination specified by the buyer within 2-7 working days from the entry into force of the sales contract. Outside Estonia, delivery will take place within 7 calendar days.

During promotions, there may be delays in delivery due to higher volumes. In exceptional cases, we have the right to deliver within 30 calendar days.

If the Online Shop has informed the buyer on the website or in the order confirmation of delivery problems and a deadline exceeding 30 calendar days, the deadline published by the Online Shop will apply.

Right of withdrawal

According to section 56(1) of the LOA, the customer has the right to withdraw from the contract within 14 days of receipt of the goods.

Returned goods must be unused, undamaged and in their original packaging.

The cost of returning the goods shall be borne by the buyer, unless the reason for the return is non-conformity with the order or defective goods.

In order to return the goods, a free-form return request must be submitted by e-mail to info@vitaplus.ee within 14 days of receipt of the goods. The return request must include the name of the Customer, the name of the product and the invoice or order number.

The Customer will be refunded the money for the returned goods immediately, but not later than 14 days after the receipt of the cancellation. In addition to the cost of the returned goods, the costs of delivery of the goods shall also be refunded.

The online shop may refuse to make a refund until it has received the goods covered by the contract or until the buyer has provided proof that he has returned the goods, whichever is the earlier.

The online shop will respond to the consumer’s complaint in writing or in a format that can be reproduced in writing within 14 days.

If the buyer has expressly chosen a delivery method other than the cheapest delivery method offered by the Online Shop, the Online Shop is not obliged to reimburse the consumer for the cost that exceeds the cost associated with the usual delivery method.

The Online Shop has the right to withdraw from the sales transaction and to demand the return of the goods from the buyer, if the price of the goods on the Online Shop has been marked significantly below the market price of the goods due to a mistake.

Direct marketing and processing of personal data

The online shop uses the personal data provided by the buyer only to process the order and send the goods to the buyer. The online shop forwards personal data to companies providing transport services in order to deliver the goods.

The online shop sends newsletters and offers to the buyer’s e-mail address only if the buyer has expressed his/her wish to receive them by entering his/her e-mail address on the website and has indicated his/her wish to receive direct mail notifications.

The purchaser may opt-out of receiving offers and newsletters by email at any time by notifying us by email or by following the instructions in the email containing the offers.

Data protection conditions

The controller of personal data of the online shop vitaplus.ee is Vitaplus OÜ (registration code 16122633), Padriku 1/5-7, Tallinn, e-mail info@vitaplus.ee. Vitaplus OÜ transfers the personal data necessary for the execution of payments to the processor Montonio Finance OÜ.

Purposes for which personal data is processed

Personal data is used for the management of customer orders and the delivery of goods.

Purchase history data (date of purchase, goods, quantity, customer details) is used to compile an overview of goods and services purchased and to analyse customer preferences.

The bank account number is used to return payments to the customer.

Personal data, such as e-mail, telephone number, customer name, are processed in order to resolve issues related to the provision of goods and services (customer support). In addition, e-mail is used to send invoices and the telephone number is used to notify the arrival of goods at the parcel machine.

The IP address or other network identifiers of the user of the online shop are processed for the purpose of providing the online shop as an information society service and for the purpose of web usage statistics.

Legal basis

The processing of personal data is carried out for the purposes of the performance of the contract with the customer (management of customer orders, delivery, return of goods and payments).

Processing of personal data is carried out for the fulfilment of a legal obligation (e.g. accounting and consumer dispute resolution).

Recipients to whom personal data are transmitted

Personal data will be transferred to the online shop’s customer support for the purpose of managing purchases and purchase history and resolving customer issues.

The name, telephone number and e-mail address will be forwarded to the transport service provider chosen by the customer. In the case of goods to be delivered by courier, the customer’s address will be transmitted in addition to the contact details.

The bookkeeping of the online shop is carried out by the service provider, the Personal Data is transferred to the service provider for the purpose of accounting transactions.

Personal data may be transferred to information technology service providers if this is necessary to ensure the functionality or data availability of the online shop.

Security and data access

Personal data is stored on the servers of Veebimajutus.ee, which are located in the territory of a Member State of the European Union or in the territory of a country that has joined the European Economic Area. Data may be transferred to countries whose level of data protection has been assessed as adequate by the European Commission and to companies in the United States of America that have signed up to the Privacy Shield framework.

Access to personal data is granted to the employees of the online shop, who can access personal data in order to resolve technical issues related to the use of the online shop and to provide customer support services.

The online shop implements appropriate physical, organisational and IT security measures to protect personal data against accidental or unlawful destruction, loss, alteration or unauthorised access and disclosure.

The transfer of personal data to the online shop’s processors (e.g. transport service provider and data aggregator) is based on contracts between the online shop and the processors. The processors are obliged to ensure appropriate safeguards when processing personal data.

Accessing and correcting personal data

Personal data can be accessed and corrected in the online shop’s user profile or via customer support. If the purchase has been made without a user account, the personal data can be accessed via the online support. If the request for access to personal data has been made electronically, the information will also be provided by commonly used electronic means.

Withdrawal of consent

If the processing of personal data is based on the consent of the customer, the customer has the right to withdraw the consent by informing Customer Support by e-mail.

Storage at

Personal data will be deleted when the online shop closes the customer account, unless such data need to be kept for accounting purposes or to resolve consumer disputes.

If a purchase has been made in the online shop without a customer account, the purchase history will be kept for three years.

In the case of disputes relating to payments and consumer disputes, personal data will be kept until the claim is settled or the limitation period expires.

Personal data necessary for accounting purposes will be kept for seven years.

Restriction

You have the right to request the restriction of the processing of your personal data if the data is inaccurate or incomplete or if your personal data is processed unlawfully.

Objections

The customer has the right to object to the processing of his/her personal data if he/she has reason to believe that there is no lawful basis for the processing of his/her personal data.

Deletion

In order to delete personal data, you must contact customer support by e-mail. A reply to the deletion request will be sent within one month at the latest, specifying the period of deletion.

Transfer to

Requests for the transfer of personal data made by e-mail will be answered within one month at the latest. Customer Support will verify the identity and notify the personal data to be transferred.

Direct marketing communications

The email address and telephone number will be used to send direct marketing messages if the customer has given their consent. If the customer does not wish to receive direct marketing communications, he/she should select the appropriate reference in the footer of the e-mail or contact customer support.

Where personal data is processed for the purposes of direct marketing (profiling), the customer has the right to object at any time to both the initial and further processing of his or her personal data, including profiling in relation to direct marketing, by informing Customer Support by e-mail (this information must be provided clearly and separately from any other information).

Use of cookies

The online shop uses cookies. A cookie is a small text file that is automatically stored by the browser on the device used by the customer. Cookies are used to collect information about how a customer uses the Web Store, with the aim of providing a better customer experience.

The following cookies are used in the online store:

session cookies, which are designed to enable the use of the Online Shop;
permanent cookies, designed to remember the customer’s choices in the Online Shop;
first- and/or third-party cookies, which are used to show advertising and offers that are relevant to the customer;
third-party analytics cookies aimed at optimising marketing communications.

Customers can delete and/or block cookies stored on their devices by changing the settings on their web browser. If cookies are not used, the Website may not function as intended and/or some functionalities may not be available to the customer.

In addition to the use of analytics cookies, the Web Store uses pixel tags (web beacons) to track a seller’s website usage. In doing so, no personally identifiable information is processed.

Dispute resolution

Disputes relating to the processing of personal data can be resolved through the Customer Support at info@vitaplus.ee. The supervisory authority is the Estonian Data Protection Inspectorate (info@aki.ee).

If the buyer has any complaints regarding the Webshop, he/she should send them by e-mail to info@vitaplus.ee or call +372 5104010.

If the buyer and the Online Shop are unable to resolve the dispute through an agreement, the buyer can turn to the Consumer Disputes Committee. You can read the terms and conditions of the procedure and submit an application here. The Consumer Disputes Committee is competent to settle disputes arising from a contract between the buyer and the Online Shop. The examination of the buyer’s complaint by the Commission is free of charge.

The buyer can turn to the European Union’s consumer dispute resolution platform.
